Existing Use: Pursuant to Case No. ZA 2002-2741(PAD)A1, the property is authorize for a commercial equestrian facility, equine rescue, and equine evacuation for the purpose of training, boarding, breeding, stabling, birthing and rehabilitation,
Proposal: No construction or expansion of the existing facility or operation is proposed. The proposal is to renew Case No. ZA 2002-2741(PAD)A1.
Purpose of City Planning Process: Approval of Case No. ZA 2002-2741(PAD)A1 included Condition No. 7 for future review for Compliance with the conditions of approval.
It is typical to impose this condition as security in protecting the area. Upon reviewing the request to renew the CUP, the Zoning Administrator will ensure compliance with the conditions of the prior approval and evaluate if the conditions were successful in protecting the community.
The condition is in case of an operator’s possible lack of sensitivity to the needs of the community and for consideration of changed conditions in the surrounding area. The intent is that through this process, the Office of Zoning Administration is able to further the City’s goal to ensure that the establishment does not adversely affect the community.

Existing Use: Childcare facility serving up to 82 children, operating between the hours of 8:00 a.m. to 5:00 p.m. as approved pursuant to Case Nos. ZA 2006-7192(CU)(YV) and No. ZA 2006-7192(CU)(YV)(PA1).
Proposal: No construction or expansion of the existing child care operation is proposed. The proposal is to renew the Conditional Use Permit. (See Letter of Determination, below)

Case No. ZA 2004-5923(PAD) – On February 18, 2005, the Office of Zoning Administration approved plans authorizing an increase in capacity from 20 to 30 children in an existing 1,800 square-foot child care facility. The approval included 15 conditions, including all loading and unloading of children on-site, all employee parking on site, and a plan approval review in five years to show compliance with conditions.
Case No. ZA 2006-7192(CU)(YV) – On August 30, 2007, the Office Zoning of Administration approved the expansion of an existing child care center in the R3 and R1 Zones (i.e., school purchased north adjoining parcel – 6051 Fulton) and a variance from Section 12.21-C,l (g) of the Code to permit more than 50 percent of the front yard to be paved, a variance from Section 12.21 -C, 1 (g) of the Code to permit 11 percent of the front yard to be landscaped in lieu of the required minimum of 50 percent and a variance from Section 12.21- C, I(g ) of the Code to permit automobile parking in the front yard in lieu of the prohibition of such use. The grant superseded the previous grant from Case No. ZA 2004-5923(PAD) and includes 32 conditions. The grant is conditioned to expire on September 1, 2017.
Case No. ZA 2006-7192(CU)(YV)(PA1) – On March 9, 2011, the Office of Zoning Administration approve plans authorizing an amendment to Case No. ZA 2006-7192(CU)(YV) by increasing enrollment from 75 to 82 children for the existing Exploring Minds Montessori Pre-School.
